Rhino-Rack USA Black Friday 2023 promotion Terms & Conditions

1. The entrant agrees and acknowledges that they have read these Conditions of Promotion (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. Prices as marked online.
4. Promotions valid on https://www.rhinorack.com/en-us/ only.
5. Not valid in conjunction with other offers or promotional vouchers.
6. Cannot be redeemed against a prior purchase. For a limited time (unless otherwise stated) and while stocks last.

DELIVERY AND RETURNS OF SALE PRODUCTS

Order Placement and Payment

1. These Terms apply to any Order placed and any purchase of Products made by the Customer through the Website.

2. The Terms are to be read together with the Account Terms of Use, the Privacy Policy, terms of use of the Website and as in addition to any terms which may be specified by Rhino-Rack in relation to each individual Order or return of the Product.

3. The Products sold are subject to these Terms to the exclusion of any other terms and conditions stipulated or referred to by the Customer. No amendments to these Terms will be binding on the parties unless approved in writing by Rhino-Rack. The Customer acknowledges that it is aware of the contents of and agrees to be bound by these Terms, the Account Terms of Use and the Privacy Policy.

4. By placing and proceeding with the Order, the Customer accepts the offer from Rhino-Rack to enter into a Contract in relation to the Order on these Terms and agrees to be bound by these Terms.

5. Before submitting an Order, the Customer must satisfy itself as to the identification and quantity of each Product it wishes to order. The Customer warrants and acknowledges that the Order is correct, accurate and complete and that the Customer has satisfied itself as to the content and price of the Order.

6. The Contract for purchase of the Products under these Terms is formed once the Customer places an Order for such Products through the Account.

7. Rhino-Rack may cancel the acceptance of any Order at any time before delivery without incurring any liability to the Customer. If Rhino-Rack cancels the Order and the Customer has already paid for the Order, where applicable, Rhino-Rack will issue a refund to the Customer for the amount of the Order.

8. All prices are stated exclusive of any applicable duties, charges, levies, fees and taxes (including the Goods and Services Tax), unless stated otherwise. The Customer will bear all applicable taxes, charges, fees, duties and levies.

9. Unless specified otherwise in relation to specific Products where delivery is included, the Customer will pay all applicable shipping, delivery and handling charges which will be billed to the Customer in addition to the price for the Products, and as part of the Order.

10. Payment for the Products and/or services must be made in full before physical delivery of Products to the Customer. No cash on delivery is accepted.

11. The Customer shall keep records of each Order and purchase and sale, showing the date of purchase or supply and the quantity received or supplied.

Shipping

12. Once your order has shipped, we will send you a shipping confirmation email containing your tracking number(s). Some orders will ship in multiple boxes and each box will have its own unique tracking number.

13. Rhino Rack USA offers standard ground services within the United States.

14. Arrives in 1 to 6 business days. Business days are Monday-Friday, excluding federal holidays. Weekend delivery is subject to carrier availability. No shipping to P.O. Boxes.

15. Please contact Rhino-Rack for shipping quote to areas outside of the contiguous US (Hawaii, Alaska, US Territories)

16. Oversized Items will be shipped using LTL Truck services. The shipping company will contact you to schedule a delivery date and time, as you will be required to sign off on the package delivery. Missing the delivery date schedule and requiring re-delivery or Saturday delivery may incur additional charges.

17. Customers are advised to provide a shipping address where customer will be present to receive the shipment. Rhino Rack USA is not responsible for packages left unattended in the event that the recipient is not available to receive a shipment.

18. We do not ship C.O.D.

19. All orders must include a complete shipping address and phone number.

20. Rhino Rack cannot deliver to P.O. Boxes, APO, or FPO.

21. For oversized product shipments to the contiguous 48 states, only freight ground is made available.

22. For certain oversized product shipments to Alaska and Hawaii, additional shipping charges may apply. Please contact Rhino Rack USA for a quote, including these additional fees.

Returns

25. Products returns are only accepted within 30 days from the date of delivery with an approved Returns Authorization (RA) number from Rhino-Rack. A product is not eligible to be returned without first obtaining an RA number from Rhino-Rack Customer Service. Any product returned without an RA number will not be processed nor will a refund be issued.

26. Once your return has been received, deemed unused, and in sellable condition, a credit will be issued for the product returned.

27. From the time that we receive your return, please allow up to 10 business days for your credit to be processed.

28. All credits will be issued to the original credit or debit card used for order processing. All Rhino Rack USA product returns need to be addressed to:

29. We understand that things change, you might want to cancel or make an adjustment to your order. Unfortunately, we are not able to change the contents of an order once it has been placed. We do require written notification if you would like to cancel an order. Please reach out to Customerservice@rhinorack.com to see if we can cancel the order for you. Other terms

31. The Customer must comply with the Product manual, specification or instruction when installing, handling and using the Product.

32. The parties shall be excused for delays in performance or failure of performance (except payment of amounts due) to the extent arising from causes beyond such party’s reasonable control, including without limitation, strikes, wars, fires, any epidemic, pandemic or disease outbreak, acts of terror or acts of God, such as floods and earthquakes. In the event of any such event or condition, the party whose performance is excused shall notify the other party as soon as practicable and shall make diligent efforts to perform its obligations at its earliest opportunity.

33. If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provisions in question will not be affected.

34. No failure or delay by a party to exercise any power or right under these Terms operates as a waiver, nor does any single or partial exercise of any power or right preclude any other or further exercise, or the exercise of any other power or right.
